2. Registration and Account

The User is responsible for maintaining the confidentiality of their credentials and for all activities carried out with their Account. Fortexa may suspend or cancel Accounts that violate these Terms or show suspicious activity.

3. Plans, Payments, and Billing

Current plans and prices are published in the “Pricing” section of the Platform. Payment for the Services is made in advance on a monthly or annual basis depending on the chosen cycle. Payments are processed through Stripe or other authorized providers.

  • Prices are expressed in USD unless otherwise indicated.
  • The annual plan includes a 20% discount.
  • Fortexa may modify prices with 30 days' prior notice.
  • Payments are non-refundable except as provided in section 9.
  • Non-payment for more than 15 days authorizes the suspension of the Account.

4. Permitted Use

The User agrees not to:

  • Use the Services for illicit purposes or purposes that violate applicable Dominican or international law.
  • Share credentials with unauthorized third parties.
  • Perform reverse engineering, mass scraping, or system attacks.
  • Upload content that infringes third-party rights or contains malware.
  • Resell or sublicense the Services without prior written authorization.

5. Client Data and Ownership

The Client retains ownership of all Client Data. Fortexa acts as a data processor in accordance with Ley 172-13 (Law No. 172-13 on the Comprehensive Protection of Personal Data of the Dominican Republic), as per the Data Processing Agreement (DPA) which forms part of these Terms. Fortexa retains Client data for a minimum of 10 years in accordance with the Dominican Tax Code for tax and audit purposes, unless the Client requests its deletion as indicated in the Privacy Policy.

6. Service Availability (SLA)

Fortexa commits to maintaining a monthly 99.9% Guaranteed availability, excluding scheduled maintenance windows (announced with at least 48 hours' notice) and force majeure events.

7. Intellectual Property

The Services, including software, designs, logos, and documentation, are owned by Fortexa or its licensors and are protected by applicable intellectual property laws. Use of the Services does not confer any ownership rights over them.

8. Limitation of Liability

Fortexa shall not be liable for indirect, consequential, loss of profit, or data loss damages arising from the use or inability to use the Services. Fortexa's maximum liability, in any case, shall be limited to the amount paid by the Client in the 12 months prior to the event giving rise to the claim.

9. Cancellation and Refunds

The Client may cancel their subscription at any time from the Settings panel. For annual plans, a prorated refund of unconsumed months is granted during the first 60 days from the start of the cycle. 10. Modifications

Fortexa may update these Terms at any time. Substantial changes will be notified to the Client by email and published on this URL. Continued use of the Services after a modification implies acceptance of the new Terms.

11. Governing Law and Jurisdiction

These Terms are governed by the laws of the Dominican Republic. Any dispute shall be submitted to the competent courts of Santo Domingo, Distrito Nacional, unless the law requires specific jurisdiction for the end consumer. The service provider is CLOUDTEXA SOLUTIONS, S.R.L. (RNC 133627515).
